In the inaugural Edinburgh Medical Debate which took place on Tuesday
September 22nd 2015, a panel representing Medicine, Law and the
Edinburgh student body debated the motion:
"This house believes
that “Mongtomery vs Lanarkshire” erodes doctors' clinical judgement in
communicating with patients about their treatment, and will compromise
patient care."
The case, recently debated in the Supreme Court,
concerned a complication called shoulder dystocia in a baby who's mother
subsequently claimed damages because doctors did not inform her of this
risk (increased due to diabetes in the mother). The supreme court
upheld the mother's case and allowed the mother to recover damages on
behalf of her child.
